§ 2 Scope of application
For business relations between us and the customer (hereinafter also referred to as "you"), the following General Terms and Conditions apply to orders placed via the Internet store www.parfum-centrum.com in the version valid at the time of the order.
§ 3 Conclusion of contract
3.1 The presentation of our products on our website merely contains an invitation to the customer to submit a contract offer. Please note that the products offered by us on this website can only represent a non-binding offer and are subject to stock availability.
We endeavor to have the products in stock at all times, but cannot guarantee this in every case and in particular in every conceivable quantity. In this respect, this is merely an invitation to submit a binding purchase offer.
3.2 You order in our store by going through the following steps.
- You place items in your shopping cart without obligation by clicking on "Add to cart"
- You can view all the items you have placed in your shopping cart by clicking on "Shopping cart". Here you can also delete items or change the quantity.
- If you would like to purchase the items in your shopping cart, click on "Checkout". This will take you to the order process.
- In the order process, first enter your personal details.
- In the next step, select the delivery and payment method.
- Before you submit your order, the recap page will give you an overview of all the details of your planned order (in particular billing and delivery address, product, price, quantity, payment method). You can correct or change your order details by clicking on "Back".
- By clicking on the "Place order" button, you place a binding order for the goods in your shopping cart. In doing so, you are offering us the conclusion of a purchase contract. By sending an order, the customer submits an offer within the meaning of § 145 BGB.
3.3 The customer receives confirmation of receipt of the order by e-mail. The contract with us is concluded when we accept the customer's offer in writing within 2 working days of the order being sent. In this respect, the time of receipt of the declaration of acceptance by the customer is decisive.
A working day is any calendar day that is not a Sunday or a national public holiday.
3.4 Orders are stored after conclusion of the contract until the end of the current calendar year, but cannot be retrieved directly by you. The contract data can either be requested from us by e-mail or telephone or accessed in the password-protected customer account, provided that the customer has created a customer account in the seller's online store before sending his order.
§ 4 Delivery, shipping costs, transfer of risk
Delivery shall be made at the shipping costs shown in each individual case. If the customer is a consumer, we bear the shipping risk in any case, regardless of the shipping method. If the customer is an entrepreneur, all risks and dangers of shipment are transferred to the customer as soon as the goods have been handed over by us to the commissioned logistics partner.
The seller only delivers to the countries specified on the Shipping page.
For orders within Germany, the delivery times are specified on the respective product page. Further information on our delivery times can be found on the Shipping page.
The delivery period begins
- for payment in advance on the day of receipt of payment or on the next working day (Mon. - Fri.)
- for all other payment methods on the day after conclusion of the contract
The delivery period ends on the following 6th day. If the last day of the period falls on a Saturday, Sunday or a public holiday recognized by the state at the place of delivery, the next working day shall take the place of such a day.
If the goods are not available or longer delays in delivery are foreseeable, the customer will be informed immediately by e-mail or telephone and, in the event of withdrawal, any payments already made will be refunded.
§ 5 Retention of title
5.1 In the case of consumers, we reserve title to the purchased item until the invoice amount has been paid in full. If you are an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or a special fund under public law, we reserve title to the object of sale until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.
5.2 You shall only have a right of set-off if your counterclaims have been legally established or are undisputed or recognized by us. Furthermore, you only have a right of retention if and insofar as your counterclaim is based on the same contractual relationship.
5.3 If the customer is in arrears with any payment obligations to us, all existing claims shall become due immediately.
§ 6 Prices/ payment methods
6.1 All prices include the statutory value added tax, plus shipping costs depending on the country of delivery.
6.2 We generally offer the payment methods displayed during the ordering process. PS Online Stores GmbH reserves the right not to offer certain payment methods for each order and to refer to our other payment options.
6.3 If the payment method PayPal is agreed, payment will be processed via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), subject to the PayPal Terms of Use, available at https://www.paypal.com/va/legalhub/guest-tnc or, if you do not have a PayPal account, subject to the terms and conditions for payments without a PayPal account, available at https://www.paypal.com/va/legalhub/useragreement-full After submitting your order, you will be automatically redirected to PayPal's secure payment form. If you already have a PayPal account, simply log in. Otherwise, click on Create account and follow the instructions. We will receive your payment within seconds and your goods can be dispatched immediately, subject to availability.
6.4 If you have chosen to pay by credit card, you will be automatically redirected to the secure payment form of the service provider GoPay after you have placed a chargeable order. For this payment method, the required details (cardholder, card number, expiration date, card verification number) must be provided. As soon as the credit card is accepted and you authorize the payment, your debit will be processed within 24 hours.
6.5 In the case of payment by bank transfer (prepayment), we will send you our bank details in the order confirmation by email. The purchase price must be credited to our bank account within 21 days of receipt of this information. If you have not made the transfer within 21 days, the order will be canceled. A reservation of the article for advance payments is therefore made for a maximum of 21 days. The goods will not be dispatched until the invoice amount has been received.
6.6 If the payment method "Amazon Payments" is selected, payment is processed via the payment service provider Amazon Payments Europe s.c.a., 38 avenue John F. Kennedy, L-1855 Luxembourg (hereinafter: "Amazon"), subject to the Amazon Payments Europe User Agreement, which can be viewed at https://pay.amazon.eu/help/201212430 If the customer selects "Amazon Payments" as the payment method during the online ordering process, he also issues a payment order to Amazon by clicking the button that concludes the order process. In this case, the seller already declares acceptance of the customer's offer at the point in time at which the customer initiates the payment process by clicking the button concluding the order process.
6.7 We reserve title to all goods delivered by us to our customers until final and full payment of the delivered goods.
